more on discovery...

Heraklietos of Ephesos:

"Whosoever wishes to know about the world must learn about it in its particular details.
Knowledge is not intelligence.
In searching for the truth be ready for the unexpected.
Change alone is unchanging.
The same road goes both up and down.
The beginning of a circle is also its end.
Not I, but the world says it: all is one.
And yet everything comes in season

think outside the Bar (.)

A brilliant article appears in this issue of the SF Weekly about the many disgusting and dirty California Bar members. Author, Martin Kuz divulges some eye opening truth about the process of filing a complaint with the Cal Bar and what the victimized clients face when they do so. There is not much to look forward to. According to California records~ less than 1% of the practicing attorneys statewide are actually punished for their malfeasance.

When you consider that California is one of only 6 states that have this piss poor system where NO non-attorneys ever get to participate in the review process or in the discipline process of these accused law practicing super egos. In fact, California is one of the worst states in the nation to punish dirty lawyers.
“That’s what happens when attorneys are policing other attorneys,” says Suzanne Blonder (senior counsel for HALT) in this article. And she also notes that the clients are forgotten about. Excellent point.

Also, in this lovely state, the Bar protects attorneys whom complaints have been filed against, not only during the review process but if they are (and almost always will be), dismissed by the Cal Bar. These filed client grievances are basically a way for the money to circulate back to…umm the attorneys, as the 43 million a year spent by the bar on this bogus discipline process is mainly comprised of monies collected for their annual membership dues.

Dirty. Filthy dirty.

(Also this 43 million helps to pay for things like an addicted member’s substance abuse issues after he has had a little reprimand slap for his unethical behavior.) Nice, huh?

So, there are other things one can do when the California Bar fails them.
Think outside the Bar.
